Article 1: General Provisions

Belgium., VAT BE0755934757, RPR WEST-VLAANDEREN DEPARTMENT KORTRIJK, (hereinafter referred to as My White Cotton bv) offers its customers the opportunity to purchase the products from its webshop online. These Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”).

When placing an order via the webshop of My White Cotton bv, the Customer must expressly accept these Terms and Conditions, by which he agrees to the applicability of these Terms and Conditions, to the exclusion of all other terms and conditions. Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by My White Cotton bv.

Article 2: Price

All stated prices are expressed in EURO, including VAT and all other duties or taxes that are obligatory to be paid by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind My White Cotton bv. My White Cotton bv is only bound by an obligation of means with regard to the correctness and completeness of the information provided. My White Cotton bv is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.

The offer is always valid as long as stocks last and can be adjusted or withdrawn at any time by My White Cotton bv. My White Cotton bv cannot be held liable for the unavailability of a product.

Article 4: Online purchases

Description of ordering procedure: The customer can go to the 'Shops' tab and choose the option 'Order online'. The customer can choose the desired product, its color and the number of pieces there. The customer can find more information under 'Description' and 'Additional information'. Once the customer is sure of his/her order, the 'add to my shopping cart' button can be used to go to the shopping cart.

Once in the shopping cart, the customer receives a message about what has just been added. If the customer has a coupon code, he/she can also enter it here and it will be automatically deducted from the total amount. The customer enters the billing information. The customer can also enter a different delivery address. The customer must enter the desired address in order to correctly complete the order and delivery. The shipment is done by B-post via Sendcloud. A shipment within Belgium costs 6.50 for the customer. For a shipment to other countries, the customer pays a shipping cost. The customer can find these shipping costs in the overview in the shopping cart under 'shipping'. The customer can also add a comment if desired. The customer now sees the total amount to be paid. This amount includes VAT. After this, the customer chooses the desired payment method. For this he/she has the choice between: Bancontact, iDeal, kbc, ing. All extra costs due to the payment method are stated, unless My White Cotton bv takes care of the costs and the extra costs to be paid.
The customer must tick the box (OPT-IN) where he/she declares to have read and agrees to the General Terms and Conditions of My White Cotton bv. The customer can read the General Terms and Conditions by clicking on the link. The customer can now click on the button 'Place order or order'. If certain fields are not filled in or are filled in incorrectly, they will receive a red error message. The customer must first solve these error messages before clicking on 'Place order or order' again. The customer will now receive an order confirmation by email.

My White Cotton bv is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders in which the Customer is involved.

Article 5: Delivery and performance of the agreement

Once the order has been created by the customer, My White Cotton bv is notified so that the order can be prepared for transport as quickly as possible. As soon as we are working on the order, we can inform the customer by clicking on the 'processing' button in our order overview. The customer will then receive an email informing us that we have received the order and that we are preparing the package for shipment. The customer's data is processed by Sendcloud, which creates a label with the necessary barcode to safely send the package with B-post. As soon as the order has been shipped, the customer will receive a notification via email that his/her order has been shipped. Delivery time depends on B-post. We work together with Bpost and Bpost strives to deliver the domestic parcels the next working day. However, this is not a guarantee. For neighboring countries they have a delivery time of 2 to 4 working days. Delivery in Belgium costs 6.50 €. For delivery outside Belgium, an additional cost will be charged to the customer. The country zone is also requested with the address details. This will automatically calculate the additional shipping amount and add it to the shopping cart. The customer thus has a clear overview of how the total price was obtained.

Articles ordered via this webshop Belgium by B-post, delivery costs up to and including 10 kg: € 6.50.
We use higher shipping costs above 10 kg.

For deliveries in the rest of the European Union, a surcharge must be paid to the value of the standard shipping cost per weight per country determined by Sendcloud (with B-post).

Deliveries outside the European Union are not yet possible for the time being.

Any delays caused after delivery by My White Cotton bv to B-post are not the responsibility of My White Cotton bv. My White Cotton bv makes every effort to deliver the order within the specified period, but cannot guarantee this as there are working with external partners.

Unless otherwise agreed or expressly stated otherwise, the goods are delivered to the place of residence of the Customer within a maximum of 4 days after receipt of the order. However, B-post strives to deliver domestic parcels the next working day. However, this is not a guarantee.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported immediately and immediately by the Customer to My White Cotton bv.

The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk already transfers to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by My White Cotton bv.

Article 6: Retention of title

The purchased articles remain the exclusive property of My White Cotton bv until the moment of full payment by the Customer. The Customer undertakes, if necessary, to point out the retention of title of My White Cotton bv to third parties, e.g. to anyone who would come to seize the not yet fully paid items.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who purchase items online from My White Cotton bv in their capacity as consumers. The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the last good.

If the Customer revokes the agreement, My White Cotton bv will refund all payments received from the Customer up to that time, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after My White Cotton bv has been informed of the decision of the Customer to withdraw from the agreement. In the case of sales agreements, My White Cotton bv can wait with the refund until it has received all goods back, or until the Customer has demonstrated that it has returned the goods, whichever comes first.

Any additional costs resulting from the choice of the Customer for a different method of delivery than the cheapest standard delivery offered by My White Cotton BV will not be refunded.

My White Cotton bv will refund the Customer with the same means of payment as the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any costs for such reimbursement.

If goods have been removed from their packaging and used, for example, returning them is no longer possible.

Article 8: Warranty

Consumers have legal rights under applicable consumer protection laws when selling consumer goods. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact My White Cotton bv customer service and return the item to My White Cotton bv at his expense.

If a defect is established, the Customer must inform My White Cotton bv as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after its discovery. Afterwards, any right to repair or replacement will lapse.

The (commercial and/or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, unless the Customer proves otherwise.

Article 10: Sanctions for non-payment
